Terms of Service

These Terms govern access to and use of NJVAULT, including studio accounts, media storage, client galleries, sharing, and downloads.

1. Acceptance of these Terms

By creating an NJVAULT account, accessing the service, uploading media, creating a client gallery, or otherwise using NJVAULT, you agree to these Terms of Service and our Privacy Policy.

If you use NJVAULT on behalf of a photography studio, company, organization, or other business, you represent that you have authority to accept these Terms on its behalf.

2. About NJVAULT

NJVAULT provides digital tools that allow photographers, videographers, creative studios, and other users to upload, organize, store, display, share, and deliver photos and videos to their clients through online galleries.

Available features may change as the service develops. We may add, remove, improve, or modify features where reasonably necessary to operate or improve NJVAULT.

3. Studio accounts

You must provide accurate information when creating an account and keep your login credentials secure.

You are responsible for activity performed through your account unless the activity resulted from a security incident caused by NJVAULT.

You must notify us promptly if you reasonably believe your account or credentials have been compromised.

4. Your media and intellectual property

You retain ownership of photographs, videos, filenames, descriptions, and other content that you upload to NJVAULT.

NJVAULT does not acquire ownership of your uploaded media.

You grant NJVAULT a limited permission to host, copy, process, resize, optimize, transmit, display, and otherwise technically process your content only as reasonably necessary to provide the service.

For example, NJVAULT may generate optimized WebP versions or thumbnails of uploaded images to improve gallery performance while retaining the original uploaded file for downloading.

5. Your responsibility for uploaded content

You are responsible for ensuring that you have the necessary rights, permissions, authorizations, or other lawful basis required to upload, process, store, and share the content you place on NJVAULT.

This includes responsibility for photographs or videos containing identifiable clients, guests, employees, children, event attendees, or other individuals.

NJVAULT should not be used to upload content that infringes copyright, privacy, confidentiality, or other legal rights.

6. Client galleries and sharing

Studios can enable or disable public client gallery links. A gallery that has sharing enabled may be accessible to anyone who possesses its valid sharing link or QR code.

You are responsible for deciding who receives a gallery link and for disabling sharing when continued access is no longer appropriate.

Clients currently do not need a studio account to access an enabled shared gallery.

7. Downloads

NJVAULT may allow users or clients to download individual original media files or complete galleries.

Gallery owners are responsible for ensuring that recipients are permitted to receive and use the files being provided.

8. Free trial

New eligible studio accounts may receive a limited free trial.

The current free offering provides up to 400 MB of storage and up to 100 images, subject to the applicable trial period and whichever applicable limit is reached first.

Videos count toward storage usage but do not count toward the image-count limit.

When a trial expires, uploads may be disabled and stored media may enter a grace period before deletion. Any applicable deletion date displayed in the account should be treated as the final opportunity to upgrade or retrieve content.

9. Paid plans

Paid plans may provide increased storage and other benefits as described on the NJVAULT pricing page at the time of purchase.

Pricing, storage allocations, billing periods, and available plan features will be disclosed before a paid subscription is activated.

Additional payment, renewal, cancellation, and refund provisions may be introduced when payment processing becomes available and will form part of these Terms or the applicable purchase terms.

10. Storage limits

Accounts may not exceed the storage or media limits assigned to their current plan.

Uploads may be rejected where completing the upload would exceed an account limit.

Optimized system-generated previews and thumbnails may be handled separately from the account's original-file storage measurement.

11. Prohibited use

You may not use NJVAULT to distribute unlawful material, infringe intellectual property rights, distribute malicious software, interfere with the service, bypass security or usage limits, access another user's account without authority, or use the service for fraudulent or abusive purposes.

You must not attempt to circumvent storage, account, trial, security, rate, or other service restrictions.

12. Suspension and termination

We may suspend or restrict an account where reasonably necessary to address security risks, illegal activity, material violations of these Terms, non-payment, abuse of the service, or threats to NJVAULT infrastructure or other users.

Where reasonably practical, we will attempt to provide notice before permanent account or media deletion unless immediate action is necessary for security or legal reasons.

13. Backups and responsibility for originals

NJVAULT is designed as a client-delivery and storage service, but studios should maintain independent copies of important original media.

NJVAULT should not be treated as the sole archival copy of irreplaceable professional work.

14. Service availability

We aim to provide reliable access to NJVAULT but cannot guarantee uninterrupted or error-free availability.

Availability may be affected by maintenance, upgrades, internet failures, hosting providers, storage providers, security incidents, or events beyond reasonable control.

15. Disclaimer

To the extent permitted by applicable law, NJVAULT is provided on an "as available" basis. No representation is made that every feature will always operate without interruption or that every uploaded file can always be recovered.

16. Limitation of liability

To the extent permitted by applicable law, NJVAULT will not be responsible for indirect, incidental, consequential, special, or purely economic loss resulting from use of or inability to use the service.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

17. Privacy and data protection

Our handling of account information, client media, contact submissions, and technical data is described in the NJVAULT Privacy Policy.

18. Changes to these Terms

We may update these Terms when the service, business model, technology, or applicable legal requirements change.

The latest version will be published on this page with an updated revision date.

19. Governing law

These Terms are governed by the applicable laws of the United Republic of Tanzania, without limiting any mandatory rights that applicable law grants to users.
